The "Uniformed Services Former Spouses Protection Act" awards a portion of military retirement pay to any ex-spouse, regardless of fault of circumstances-or the duration of the marriage, no matter how brief.

For example, an Air Force member gets married as an Airman First Class, divorced as a Staff Sergeant and then goes on to complete 30 years and retires as a Chief Master Sergeant, that Airman will pay the former spouse based on their Chief retired pay.

In addition, the act does not address unscrupulous former spouses who collect payments from several marriages, nor does it stop payments if the former spouse remarries. Ironically, if your former spouse remarries then he or she will continue to receive part of your retirement pay, but if your spouse is receiving payments under the Survivor Benefit Plan and remarries before age 55, the spouse will lose all payments.

This law has been unchanged since it was passed in 1981, at the minimum it is time for a review, change and possibly a repeal.

You can use the Voter's Voice application to write your elected officials about this act and encourage them to support legislation to change or repeal this act.
